The Sustainable Business Collective and The Foundation Circle

1. Who provides the program

“We”, “us” and “our” means The Wellbeing Curators Pty Ltd trading as Jen Wressell – Strategy, Self and Systems, ABN [21 663 845 118]. “You” means the individual or organisation named in the application. If an organisation pays, it confirms that its nominated participant may attend; the organisation remains responsible for payment, and the participant must follow the conduct, confidentiality and materials terms. 2. Application and acceptance

An application is not an offer of a place. We may discuss fit, group composition, capacity and location before offering / accepting a place. Your place is confirmed only when we send written acceptance and the first payment is received, unless our acceptance expressly states otherwise. If we cancel a program after taking payment, we will promptly refund that payment. We will tell you the cohort, dates, venue or online format, inclusions, price and instalment dates before you commit.

3. What is included

The schedule at the end of this document describes the core services of programs. Session dates, experts and resources may be set out in a separate offer summary. An expert or venue may change for a reasonable operational reason, but we will provide a reasonably comparable session or venue where possible and notify you promptly. We will not materially reduce the program, switch an agreed in person component to online, or change the price during your term without your agreement. Clause 8 explains your choices if a material change or cancellation occurs.

Participation includes access only for the named participant. Sessions and community spaces are intended for professional learning, strategic planning and peer discussion. They are not a promise of revenue, profit, particular business results, referrals or individual advice on every issue raised.

4. Fees and payment

All amounts are in Australian dollars. A monthly or quarterly payment option spreads the fee for the stated fixed term; it is not an automatically renewing membership. We may use an external party, like Stripe or Paypal to process payments and will provide a receipt or tax invoice as applicable. We will give reasonable notice of a failed payment and an opportunity to update payment details. We may pause future access while an amount remains overdue after notice, but will restore access when it is paid. We will not charge an undisclosed late fee or change your agreed instalment amount unilaterally. A payment dispute or chargeback does not remove either party’s statutory rights.

5. Attendance, access and your responsibilities

You are responsible for arranging your own travel, accommodation, equipment, internet and insurance, unless the offer summary explicitly includes them. Please let us know promptly about accessibility needs so we can discuss reasonable arrangements. If you miss a session for your own reasons, let us know as soon as practical. We will provide an available recording, materials or a reasonable alternative where feasible, but cannot guarantee that a private group discussion or in person experience can be recreated. Missing a session does not by itself cancel the agreement or an instalment. We will consider exceptional circumstances in good faith under clause 7.

You agree to participate respectfully, comply with reasonable venue and online community rules communicated in advance, and avoid harassment, discrimination, threats, unlawful content and unsolicited selling to members. You remain responsible for decisions about your business and for obtaining your own legal, tax, financial, clinical or other regulated advice where needed. Do not upload or discuss identifiable client, patient, employee or other third party information in group sessions, shared tools or community spaces unless you have a lawful basis and we have agreed an appropriate secure process in writing. Use deidentified examples wherever possible.

6. Confidentiality, privacy and recordings

Members may share sensitive business and personal information. You agree not to disclose another member’s nonpublic information outside the group or make your own recording, transcript or screenshots of a session without written consent from us and the people concerned. We will ask members to observe the same rule. We will not use your name, image, words or business as a testimonial or case study without separate permission.

We will handle personal information in accordance with applicable privacy law and our Privacy Policy. Before any recording, we will explain what is recorded, who may access it and for how long, and seek any consent required. Where a session contains sensitive peer discussion, we may choose not to record it. We may engage facilitators and service providers to deliver the program subject to appropriate confidentiality arrangements.

7. cancellation and early exit

Send a cancellation request to jen@thewellbeingcurators.com. We will acknowledge it in writing and give you an itemised calculation of any payments outstanding. If you cancel before commencement or leave during the fixed term for a change of mind or a reason outside our control, we may retain or charge only a reasonable amount for services already supplied and reasonable, evidenced costs or losses caused by your cancellation that we cannot avoid or recover, taking account of whether we can fill your place. The amount payable will never exceed the agreed unpaid fee for your remaining fixed term. We will refund any prepaid balance after that calculation within 14 days. Tell us if illness, caring duties or another significant circumstance affects participation, we will consider a transfer, deferral or other fair solution. We will confirm any agreed arrangement in writing.

The six month Sustainable Collective term and three month Foundation Circle term define the period for which we reserve program capacity. They do not override the calculation above or your rights under the Australian Consumer Law. There is no automatic renewal and no cancellation notice needed at the end of the term. Any further program engagement requires a fresh agreement.

8. If we change, postpone or cancel services

We will give you prompt notice if a session must move due to facilitator illness, venue issues, safety or circumstances beyond reasonable control, and offer a reasonably comparable replacement within a reasonable time where possible. If we cannot provide a paid component, we will offer an appropriate replacement or refund the value of that component. If a change materially alters the agreed program, we will seek your consent to the change; if you do not agree, you may end the affected agreement and receive an appropriate refund of prepaid services not supplied, plus any other remedy required by law. We will not keep charging for periods in which we cannot supply the agreed service. If we cancel the whole program before it starts, we will refund all program fees paid. We are not responsible for independently booked travel or accommodation except to the extent the law requires please consider flexible bookings and travel insurance.

9. Suspension or termination for serious conduct

We may ask you to stop conduct that materially disrupts the program or puts others at risk. Except where immediate action is reasonably necessary for safety, serious misconduct or legal compliance, we will explain the concern and give you a reasonable opportunity to respond or remedy it. We may suspend access while we assess a serious issue. If we terminate for a substantial breach, we will make a fair, itemised assessment of fees for services delivered and reasonable losses caused by the breach, and refund any remaining prepaid amount. We will not use this clause to avoid a refund or other remedy required by law.

10. Materials and intellectual property

We and our contributors retain ownership of program materials. During the program term, and afterward for materials you have lawfully downloaded, you may use them within your own business for internal purposes. You may not resell, publish, distribute, teach from, or upload substantial materials to a shared resource or AI system without our prior written consent. Your pre-existing materials remain yours. You grant us permission to use anything you submit only as reasonably needed to deliver the program, subject to clause 6.

11. Consumer guarantees and responsibility

Our services come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies, including due care and skill and fitness for a stated purpose. Nothing in these terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded. If there is a problem, please contact us so we can assess it and provide a remedy. To the extent permitted by law, each party is responsible for loss caused by its own acts and omissions. Neither party is responsible for a failure caused solely by the other party’s actions. No clause requires you to indemnify us for our own negligence or breach. We do not limit liability for fraud, wilful misconduct, personal injury caused by negligence, or liability that cannot lawfully be limited.

12. Concerns and disputes

Email jen@thewellbeingcurators.com with any concerns and your preferred outcome. We will acknowledge it within five business days and make a genuine attempt to resolve it within a reasonable time. Either party may seek independent advice, mediation or an available consumer or court remedy at any time. These terms are governed by the laws of Victoria, Australia. The parties submit to courts with jurisdiction in Victoria, without removing any right to bring a claim in another forum where applicable law permits.

13. Changes to these terms

The version provided to you at acceptance applies for your fixed term. We may correct a clerical error or make a change required by law with notice, but will not materially reduce your rights or increase your fee during that term without your agreement. A new term, if agreed, may be offered on updated terms supplied before acceptance. If a provision is unenforceable, the rest continues so far as lawful.

Schedule A — The Sustainable Business Collective

Audience and format. A facilitated group for senior managers and business owners seeking a more sustainable, profitable business, clearer systems and accountability, and space to lead strategically. Groups are intended to have approximately 8–10 members. We will propose a Melbourne or Gold Coast cohort based on fit and availability; your confirmed location and dates appear in your offer summary.

Included. Four private in person gatherings, inclusive of lunch & dinner over a full 12 month participation period, featuring expert led workshops, peer advisory or hot seat sessions, strategic planning and review; group accountability sessions between gatherings; an online peer community; and relevant templates, tools and resources. Expert names and exact topics may vary, while the stated type and substantial value of the service will be maintained.

Term and investment. Six months minimum commitment from February 2027. Total AUD $3,900, payable as six monthly instalments of $650 or two quarterly instalments of $1,950, plus GST. Participation for a further six months, which would complete a full annual cycle, requires a separate written acceptance and fee disclosure.

Schedule B — The Foundation Circle

Audience and format. A facilitated group for emerging or early business owners who want direction, confidence, structure and practical progress. Delivery is online, with between 8 -10 members in a circle. Commencing February 2027, the learning plan covers a 12 month cycle with different expert topics covered each month.

Included. Monthly online group strategy sessions, Monthly online expert sessions, relevant templates and resources and access to a peer community. A named expert or topic can change reasonably under clause 3.

Term and investment. Minimum three month term; total AUD $1350, payable as monthly instalments of $450 plus GST. Participation for a further 3, 6 or 9 months requires a separate written acceptance and fee disclosure
